1. To whom do I address my appeal?

2. Does the Commission have appeal forms that I can fill out?

3. Do I need to forward any other documents besides my appeal letter?

You should include those documents that will help you present sufficient facts and reasons upon which your case is based

4. How soon before my item goes before the Commission?

3-5 weeks from the date of filing of the appeal, however, this period can be prolonged because of missing documents or in cases where additional documentation is needed prior to the matter being scheduled for the Commission’s agenda.

5. How many days do I have to file an appeal?

In a discharge, reduction or suspension over five days within 15 business days after service of the discipline letter.

In all other matters, not later than 10 business days after the ruling or order complained of, except as provided in Rule 6.07.

Note: The filing of a departmental grievance or an appeal in another jurisdiction, such as the Employee Relations Commission, shall not constitute good cause for extending the time limits for filing a petition with the Commission.

6. Do I have to be present at the Commission meeting?

Your presence is not mandatory, however attendance at the meeting will give you or your representative an opportunity to clarify your position or answer any questions the Commission might have.

7. Do I have any further recourse if my appeal is denied?

Civil Service Rules 4.03B provides for filing an amended appeal within 10 business days of the date of denial of the original petition. When an amended appeal is submitted, the Commission is looking for new information which has not been previously submitted.

8. If the Commission grants a hearing, how soon before my hearing date is scheduled?

2-4 months, depending on the availability of the Hearing Officer, the department’s representative, and your representative.

9. How many days does the hearing officer have to submit the report?

30 days after receipt of the closing briefs or if closing arguments were verbally presented, thirty (30) days from the closing of the hearing.
